And they're not websites, they're P2P programs marketted for legal uses and then abused. In effect it is not the program breaking the law but the users. Such a website however, would clearly be the source illegal material.

Because it was made for legal use.. the programmers and publishers are not at fault... how people use it is illegal, the government has to go after the people that use it illegally since in effect the developer is doing NOTHING wrong...

Sharing freeware and Opensource. Sharing music/software that people have recorded/programmed by themselves and want to share. Stuff like that.

I think napster did a thing where you paid them, then they paid royalties to music companies for the sharing. Hence making it sorta legal by agreement.
